Terms of Service

By accessing or using Wellpipe ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Wellpipe is a health data aggregation service that connects wearable devices and health platforms to AI assistants via the Model Context Protocol (MCP). The Service allows you to:

• Connect your health data providers (e.g., WHOOP, Oura)
• Access your health data through AI assistants
• Query your health metrics using natural language

To use certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us of any unauthorized use of your account

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Share your API keys with unauthorized parties
• Exceed rate limits or abuse the Service

Prohibited Uses

The following uses of the Service are expressly prohibited:

• Clinical or Medical Decision-Making: Using the Service or AI-generated insights as a basis for clinical diagnosis, treatment decisions, or medical care
• Healthcare Operations: Using the Service in regulated healthcare settings where HIPAA or similar regulations apply
• Emergency Response: Relying on the Service for emergency medical situations or time-critical health decisions
• Third-Party Medical Advice: Using the Service to provide health advice, diagnosis, or treatment recommendations to others
• Reselling Data: Selling, licensing, or redistributing health data obtained through the Service

The Service provides access to your health data for informational purposes only. Wellpipe does not provide medical advice, diagnosis, or treatment. Always consult with qualified healthcare providers for medical decisions.

HIPAA Disclaimer

Wellpipe is not a HIPAA-compliant service. The Service is not designed, intended, or authorized for use in connection with protected health information (PHI) as defined under the Health Insurance Portability and Accountability Act (HIPAA).

Healthcare providers, health plans, healthcare clearinghouses, and their business associates should not use Wellpipe to process, store, or transmit PHI. We do not enter into Business Associate Agreements (BAAs).

AI Assistant Data Processing

When you use Wellpipe with an AI assistant (such as Claude, ChatGPT, or others), your health data is transmitted to and processed by third-party AI providers. By using the Service, you acknowledge and consent to:

• Your health data being sent to AI providers when you make queries
• AI providers processing your data according to their own privacy policies and terms
• The AI provider's data retention and usage policies applying to your health data

You are responsible for reviewing and accepting the terms of any AI assistant you use with Wellpipe.

The Service integrates with third-party health data providers and AI assistants. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

Health Data Providers

When connecting health data providers, you agree to comply with their terms of service:

AI Assistants

When using Wellpipe with AI assistants, their terms also apply:

The Service and its original content, features, and functionality are owned by Excitable Robot Publishing, LLC. The open-source components are subject to their respective licenses (MIT License).

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. IN NO EVENT SHALL EXCITABLE ROBOT PUBLISHING, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

We reserve the right to modify these terms at any time. We will notify users of material changes by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.

We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users or the Service.

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
